Internet Reserach by Jurors

Posted on November 12, 2009 02:53 by John Kuppens

Here is a link to a very interesting case out of South Dakota in which a defense verdict in a wrongful death case was vacated because of juror misconduct involving internet reserach. I invite you to share your comments about the best way to prevent these types of problems.

It is increasingly a problem.  One of my collegues was recently involved in voir dire and one of the potential jurors admitting to having a blog.  The judge pulled up the blog live in the courtroom and the juror was blogging about the jury duty experience itself (and his determination not to serve). At a minimum, it seems there should be a form instruction regarding internet communications, much like there is for other media.
